Legal Terms and Conditions for Online bookings

  1. Products available: -

    This Site allows St. Helens Council (Go Active) Customers to make reservations for some activities available within its service. The reservation is effective only after full payment has been paid. If the appropriate Membership affords free use of selected activities, the full reservation process has to be completed to ensure the booking is secured. St. Helens Council does not sell memberships directly to children: if you are under 16 you can use the Site only with the supervision of a parent or guardian. Please read these Terms and Conditions. By using the Online Service you indicate that you accept the Terms and Conditions and that you agree to abide by them. If you are not willing to accept these Terms and Conditions you may not use the Service.

    The Terms and Conditions relating to this service should be viewed as an addition to the Membership Agreement and support, not supersede each other.

  2. Available Activities or Classes: -

    Not all activities or classes available within the Go Active facilities are available to be booked Online. Please review the website of the appropriate venue for a full and conclusive timetable. Activities available to book Online include: -

    • Fitness Classes (except Aeromix, Zumba, Glorobix)
    • Badminton
    • Squash
    • Football (Outdoor)
  3. Booking Criteria: -

    As noted above all activities and classes are not available at all centres. This may be due to the fact that it is not necessary to reserve places on some classes or a pay-and-play schedule is in practice for some classes.

    The Online Booking Service can be viewed by anyone. However, to use the Online Service all users must have their details on record within the Management Information System used by Go Active, including their full address, email, date of birth and phone number. This is the pre-designated criteria used by the software programme to identify the user. Full Members can use their membership card number to register for online bookings and Casual users will need an Access Card number which can be issued from any Go Active centre reception point. The "owner" of the membership/Access Card must be in attendance for all bookings made against their specific membership. It is not permitted for card holders to secure a booking for friends or associates in their absence.

    Card holders are permitted to secure consecutive time allocations for their personal* use but it is not permitted to secure more than one class/session at any one time adjacent to another. *(Personal use is described as recreational or social use and not for the purpose of securing group or block bookings, the provision of any coaching or personal gain by the member)

    It is the responsibility of the card holder to ensure that all participants attending the session with the member (e.g.: badminton or squash partner) have their own valid membership allowing free access within these terms and conditions or pay the appropriate pro-rata price for the court hire prior to use.

    Go Active operates a policy of allowing card holders up to 7 Online activity bookings per day (49 per week) and a maximum of 10 items (activity or class bookings or a combination of the two) may be held in the checkout basket at any one time. Users can access the Online service at any time and may book activities and classes up to 7 days in advance and classes up to 6 days in advance, in line with the standard Go Active booking policy.

    Any pre booked spaces not checked in, will automatically be released at the advertised start time (and you will incur a non attendance charge).

    Members who contravene any of these booking criteria noted above will have their Online service withdrawn and their membership may be suspended.

    PLEASE REMEMBER TO BRING YOUR ACCESS/MEMBERSHIP CARD WITH YOU TO THE CENTRE TO CHECK IN FOR YOUR BOOKING OR CLASS.

  4. Cancellation Policy: -

    Go Active operates a no refund policy for transactions made from this Online service. However, if an activity or class payment has been made and cancelled within the standard cancellation criteria, a credit system will become operational. This "credit" can be used at the discretion of the customer but only on bookings reserved directly at the specific venue, to an equal or lesser value and not for further Online services.

    The cancellation policy for Online bookings is reflective of the standard cancellation policy and is noted within the Terms and Conditions of the Membership Agreement. Refunds are at the discretion of the management. A minimum 24 hours' notice is required for all cancellations.

    For non-member pre-paidbookings, cancellations must be made by telephone, by e-mail or by visiting the relevant Go Active Centre. Provided advance notice is given as per the booking policy, the booking may be moved to an alternative date within the following seven days.

    For member bookings, the same cancellation policy applies however members are expected to process the cancellation themselves on line via the on screen instructions. (Further assistance for this is available via the 'Help' link at the top of the web page).

    PLEASE NOTE: Non-attendance for bookings without cancellation notice will result in the full activity booking fee being payable. Members will not be able to make further bookings or access a facility until full payment has been made for the missed booking.

  5. General: -

    St. Helens Council reserves the right at its discretion to withdraw access to the Go Active Online booking scheme from any person(s) who misuses the scheme or who does not follow the conditions of use. These conditions of use are subject to change at any time without notice. You must check these conditions of use before making a booking.

  6. Use of Site Material: -

    The contents of this site, such as text, graphics, images and other content (the "Site Material") are protected by copyright. St. Helens Council authorizes you to view and download a single copy of the site material for your personal use. Unauthorized use of the Site Material violates copyright, trademark, and other laws. You agree to retain all copyright and other proprietary notices contained in the original site material on any copy you make of such material. You may not sell or modify our site material or reproduce, display, distribute, or otherwise use the site material in any way for any public or commercial purpose. Use of the site material on any other web site or in a networked environment is prohibited.

  7. Terms of Services: -

    The main function of this Site is to connect Go Active customers to the St. Helens Council servers using an Internet web session. This site provides no other service; all the data is physically stored and managed on the St. Helens Council servers and are is never stored, even temporarily on this site.

  8. User Name and Password: -

    You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account with or without your knowledge. If you knowingly provide your login or password information to another party your use of the site may be suspended temporarily or terminated. You agree to immediately notify St. Helens Council of any unauthorized use of your account or password or any other breath of security.

  9. Trademarks: -

    The names, marks and logos appearing on the Site or included in the site material are, unless otherwise noted, trademarks owned by or licensed to St. Helens Council or an affiliated organisation. The use of these marks except as provided in these Terms and Conditions is prohibited.

  10. Compliance with Laws: -

    You agree to comply with all applicable local, national and international laws, rules and regulations, including without limitation, laws governing on line conduct and the unlawful export of software or technical data to restricted individuals or countries.

  11. Communications with You: -

    St. Helens Council (Go Active) may communicate with you via email regarding your use of the site or your submission of materials through the site. You agree to receive emails necessary for the normal functioning of the site.

  12. Limitation of Liability: -

    St. Helens Council, its employees or agents do not accept any responsibility or liability for any loss or damage, such as loss of earnings, loss of income, loss of fee's, nor do they accept responsibility or liability for bookings being unavailable.

  13. Privacy and Security Policy: -

    St. Helens Council will keep your personal information private and secure in line with Data Protection Legislation. When a Customer registers or makes a reservation from the web site, they provide personal information such as name and a password to their Online account. Depending on your membership access rights you may also be asked to provide additional information including your home address, e-mail address, and telephone numbers. St. Helens Council will use this information to process bookings and to keep the customer updated on their bookings. Debit/Credit card details will only be requested when paying for goods and services provided by St Helens Council, no debit/credit card data is retained by the Council. When paying for goods and services online please ensure if you are in a public place that you are not overlooked as you enter your details to prevent them being misused by somebody else.

    All the data transmitted between the site and the client web browsers are encrypted through the HTTPS protocol, with a SSL certificate (see the sign at the bottom of the page or follow the link). If you are in doubt about the correctness of the HTTPS connection, please stop immediately to use this service and inform St. Helens Council.

    By registering or booking on this site you consent to the collection, use and transfer of your information under the terms of the privacy and security policy.

    St. Helens Council employs robust security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage and reserves the right to update or otherwise alter its security practices whenever considered necessary.
